Sorry about all the legal speak, it’s no fun is it. But please read this page carefully. The information contained here is designed to make sure we’re both on the same page and we’re both legally protected when we enter into a contract for services agreement.
Your estimate
Your estimate is created for your use only and is non-transferable. Your estimate provides pricing and delivery information for copywriting services and is valid for 14 days from the date it was issued. If you have any questions whatsoever, please don’t hesitate to email me.
Your cooperation
As a client of Jason Martin and Healthy Words you will be asked to provide relevant information and reference materials. This will ensure that I (Jason Martin) am able to deliver copy that meets your objectives as outlined in the agreed copywriting brief.
Duty of care
Jason Martin, Healthy Words and any and all parties operating within, agree to provide you with high quality copy created specifically with your objectives in mind. All copy is original work, free from plagiarism.
Intellectual property
All copy, whether completed, in progress or cancelled remains the intellectual property of Jason Martin and Healthy Words until payment is received in full. Once you assume ownership of the completed copy Jason Martin and Healthy Words reserve the right to include the work in a portfolio.
Please note: Jason Martin and Healthy Words’ portfolio is used to showcase previous work and is not sold or redistributed. This portfolio may be published digitally on websites belonging to Jason Martin and Healthy Words, third party websites where appropriate, or displayed in a printed portfolio.
Project Rate estimate scope
To ensure the service agreement is as transparent as possible, Jason Martin and Healthy Words always provide estimates using Project Rate pricing. Your estimate outlines your financial investment for copywriting work and a maximum of 4 hours of research time (which is more than enough 99% of the time).
Your estimate does not include time spent attending client meetings in person, on the phone or via Skype, out of pocket travel expenses incurred relating to client meetings (fuel, parking, phone call costs), additional research time required beyond the allocated 4 hours or any out of pocket financial expenses incurred obtaining research materials.
Hourly Rate billing
Whilst the majority of clients prefer Project Rates, you may prefer I (Jason Martin) use an hourly rate for your copywriting needs.
When using an hourly rate for billing, Jason Martin and Healthy Words use FreshBooks time tracking software to ensure you are billed accurately. Billable hours include copywriting time, research time, any time spent traveling to and participating in client meetings and discussions in person, on the phone or via Skype. You will also be invoiced for any out of pocket expenses incurred as a result of these activities.
Delivery of reference materials
Jason Martin and Healthy Words reserve the right to re-prioritise or reschedule the delivery of completed copy in the event that the client (you) do not deliver information and reference materials within an agreed period.
Amendments
One round of amendments in accordance with the agreed brief are included in your estimate at no charge. Any additional amendments beyond those outlined in the first round or amendments which fall outside the scope of the agreed brief are subject to additional fees.
Payment terms
An invoice will be issued on the date your draft copy is submitted for approval. This invoice will reflect the value outlined in the estimate plus any additional research or meeting hours and out of pocket expenses. The invoice amount is to be paid within 14 days of the invoice date.
Note: 28 day terms are available to approved, ongoing clients only.
Accepted payment methods
Payment can be made by direct deposit, credit card or PayPal – these details will be included on your invoice. When you choose to pay by credit card or PayPal, you’ll notice the payment recipient is listed as ’8Wire Digital’. 8Wire Digital is the parent company of Healthy Words. Please see the Frequently Asked Questions page if you’d like to know more about 8Wire Digital.
Please note: Healthy Words is unable to except cheques.
Overdue payments
In the event full payment is not received on the first business day following the due date of any invoice, penalty interest may be applied to any outstanding invoice balance in accordance with, and at the rate determined by the penalty interest legislation of Victoria and Australia.
Cancellation
In the event you wish to cancel a project after work has commenced, a cancellation fee is payable for all copywriting work performed, research and client meeting hours expended and out of pocket expenses incurred. The cancellation fee is the value of the completed work based on the prices outlined within your estimate.
Legal acknowledgement
Your estimate represents the agreement between Jason Martin (Healthy Words) and you, the client and can only be changed or modified with the written consent of both parties. By accepting this agreement you acknowledge that you have the authority to enter into this binding contract which is enforceable in accordance with the terms outlined within, as governed by the law of Victoria, Australia.
